Abstract

The article provides a conceptual analysis of the philosophical and moral foundations of the institution of punishment. It clarifies the concept of punishment, comparatively examines the major theories of its justification — retributive, consequentialist, mixed, and communicative approaches — and considers the principles that establish the moral limits of punishment, including legality, proportionality, humanity, and respect for human dignity.
